The words «we», «us» and «ours» refer to BestRanking.

All other operating rules, policies and guidelines governing your use of the Website that are referred to here or that we may otherwise publish on our Website may be amended from time to time, including without limitation:

  • Our «Privacy Policy»

The User Guidelines will govern and control any conflict between the terms contained here and those of them.

You agree to be subject to the User Guidelines when using the Website. If you don't accept the User Terms, you won't be able to use the Website anymore. Acceptance of these User Terms is required for the registration as a user.

The services on the website

  1. Registered User

    1. To gain full access to the Website, you must create a profile and register as a user (hereinafter referred to as «Registered User»).
    2. You must be at least 18 years old to become a Registered User.
    3. You cannot register more than one person on the Website. After the registration your profile will be created. You cannot transfer you profile to others.
    4. If you choose to register with an email, you will also need a password to become a Registered User. When logging in to the Website, you have to use your email address and your password. You cannot transfer the password to someone else or make it available to others. It's your responsibility to make sure that the password does not fall into the wrong hands. You are obligated to inform us if you become aware that the password has been compromised. If the password has been used in violation of the User Terms, we can change it.
    5. You have to choose a username during the registration process. Whenever you vote, write or comments on rankings or produce user-generated content on the Website, the username will be shown. If you want to be identified by others, you must use a username from which other Website Users can identify you. Usernames must not be offensive or insulting nor contains the terms Guest, Admin, .org etc... You agree that your usernames does not violate any intellectual property rights belonging to any third party or the User Terms. If you choose to upload a profile photo, the restrictions and warranties set out in this clause apply to your profile photo and you confirm that you have all titles and rights to the picture.
    6. We have the right to remove, suspend or change your profile in the event of your violation or suspected violation of these User Terms or applicable law. You will no longer have access to services on the Website if you deleted your profile. We reserve the right to remove user-generated content from the Website when you remove your profile.
    7. We reserve the right to remove your profile and user-generated content at any time. In this case, we have no limitations. If you are not a registered user, you can't gain access to the parts of the Website that require user registration.
    8. If you are not a registered user, you can't gain access to the parts of the Website that require user registration.

  2. User generated content from Registered Users

    1. The rights (including all intellectual property rights) in any material, information, notifications, reviews, articles or other types of communication are allowed to the fullest extent permitted by law to BestRanking for its non exclusive use. We refer to «User-Generated Content» as «UGC». The registered user is not entitled to royalty payments. We can use and transfer the UGC. Our non-exclusive access to freely use the UGC applies without any time limitation or territorial limitations
    2. Users who are registered on the Website are liable for the content they publish.
    3. All UGC posted on the Website should be correct and true if they state facts or opinions.
    4. The User Guidelines regulate what Registered Users can write about.
    5. Registered users must not publish UGC on the Website which:
      • is used for marketing purposes,
      • is deceptive, misleading, fraudulent, threatening, abusive, harassing, libelous, defamatory, obscene, sexist, political or racist or violates other's user rights such as intellectual property, privacy rights or publicity rights,
      • is offensive or in violation of any applicable local, national or international law or regulation,
      • is in breach of the User Terms, disclose any personal information about another's person name such as full name, email, address, telephone number, credit card details or any information that could be used to track, contact or impersonate that person
      • has an unlawful or disloyal content,
      • is technically related to Computer Viruses, logic bombs, Trojan horses, worms, harmful components, corrupted data or other malicious software, harmful data or conduct
    6. Contributors of the UGC warrant that the UGC is in compliance with the User terms.If BestRanking is aware of a violation of current legislation and/or the User Terms, we may remove the UGC without notice, and we may inform the violated party and/or the authorities of the violation. We will try to inform the registered user of the reason for the deletion, but our right of deletion for UGC won't be conditioned on an explanation.
    7. The registered user grants us the right to initiate and take any legal actions which we deem necessary in case of violation of the registered user's UGC.

      The Registered User must guarantee to indemnify us for any claims which may be made against us as a consequence of the registered user's violation of the user terms. The Registered User must indemnify and hold us harmless from and against any claim or loss due to third party claims against them.
    8. Documentation supporting the information included in the UGC can be requested by BestRanking at any time from the registered user.

  3. Rights

    1. All intellectual property rights embodied in the Website are our sole and exclusive property, and no license or right is granted to any underlying technology. We are free to exploit any feedback you give.
    2. The content on the Website, including but not limited to the intellectual property rights, text, characteristics, graphics, icons, photos, calculations, references and software is or will be our property or the property of a third party and is protected by U.K and and applicable international legislation, including without limitation applicable copyright and trademark laws.
    3. Unauthorized copying, distribution, presentation or other use of the Website or part hereof is a violation of UK law and may result in civil and/or criminal penalties.
    4. By submitting any UGC, the rights to use freely any of the UGC are transferred to us irrevocably, without any time limitation and without territorial limitations.
    5. Unless otherwise agreed with us in writing or allowed under applicable mandatory law, digital copying of the content on the Website or parts hereof is only permitted for personal non-commercial use.
    6. All company names, trademarks and other business characteristics on the Website are or will be the property of BestRanking or a third party and must only be used for business purposes upon prior approval from us or the third party owner.

  4. Personal Data

    1. We process personal data in connection with the use of the Website. Our Privacy Policy governs the processing of personal data. Our Privacy Policy can be obtained here. Accepting our User Terms implies you have read and accepted our Privacy Policy

  5. Disclaimer and Indemnification

    1. The Website, content and services offered on the Website are provided “as is”, and we make no warranties with respect to the content or accuracy of the UGC or the Website and shall not be held liable for our own or others' deletion or blockage of the UGC. We may, at any time at our own discretion and without any liability, delete any content on the Website, We expressly exclude all conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity.
    2. We won't look at or monitor the UGC that is published on the Website. We may at all times investigate and edit if the actions are prompted by third party requests or if they are necessary for the compliance with our User Guidelines.
    3. We aren't responsible for the UGC on the website. Our non-liability does also apply to any UGC that has been edited by us. The content of the page that links to third party websites is not our responsibility.
    4. Recommendations, reviews, comments, etc. on the Website are only guidelines. We aren't liable for the content of the Website, nor we are liable for the availability of the Website
    5. We are not liable for damages for the use of the Website, including loss of profits, contracts, turnover, business, business opportunity, loss or corruption of data or recovery of data, goodwill, security breach and/or a failure of third party telecommunications.
    6. Nothing in the User Terms limits or excludes our liability for death or personal injury arising from carelessness, or for fraudulent misrepresentation or misrepresentation as to a fundamental matter, or any other liability which cannot be excluded or limited under applicable law.

  6. Other User Terms

    1. We may at any time and without notice revise or change these User Terms or, in our own discretion, close or reorganize the Website. As a Registered User, you are accepting to be covered by the current User Terms. Modification of the User Terms will be posted on the WebSite. The continued use of the Website after any posted modified version of the User Terms is an acceptance of the modified User Terms for Registered Users.
    2. If any of these User Terms are regarded as illegal and therefore not enforced, the applicability and enforcement of the remaining part of the User Terms will not be affected.
  7. Term and Termination
    1. We can end access to the Website at any time without liability. Any rights granted to you will cease whether we end your access or if you choose to remove your profile. Any Registered Users who see his/her rights to access the Website revoked are still liable in accordance to the section 2.13 of the User Terms.
  8. Applicable Law and Venue
    1. Unless otherwise stated, the general rules of British law apply in all relations between us and the Registered Users and the users of the Website.
    2. Unless mandatory jurisdiction rules states the court location, any disputes must be brought to the court of BestRanking British jurisdiction.
